In Rhode Island, settlement reached in birth injury case

The minor plaintiff was born after a difficult delivery in which labor was protracted and descent was slow. It was anticipated prior to labor that the baby was large, and yet the defendants decided to try a vaginal delivery. After a delivery in which the baby didn't fit well through the birth canal, the baby’s head was swollen, his collarbone was fracturued and he was having difficulting breathing. He weighed over 10 pounds. The claim was that he should have been delivered by cesarean section as it was reasonably expected that delivery through the birth canal would be traumatic. The defendants offered nothing prior to trial, but after three weeks of evidence, the defendants settled by putting up all of the available insurance coverage.
